These terms and conditions of sale are concluded on the one hand by the company PREMIUM WATER DISTRIBUTION SAS whose head office is located in Castet Arrouy FR-32340, 1570 route de Miradoux, registered in the Auch Trade and Companies Register under the number 852 344 456 00011, managing berkey-france-millenium.fr and, on the other hand, by any natural or legal person wishing to make a purchase via the website berkey-france-millenium.fr hereinafter referred to as "the buyer".

1-Object

These terms and conditions of sale aim to define the contractual relationship between Premium Water Distribution and the buyer and the conditions applicable to any purchase made through the website https://berkey-france-millenium.fr. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares on the one hand that the purchase of products on berkey-france-millenium.fr is not directly related to his professional activity and is limited to strictly personal use and on the other hand has full legal capacity, allowing him to engage under these general conditions of sale. The company Premium Water Distribution reserves the right to modify these terms and conditions of sale at any time, to comply with any new regulations or to improve the use of its site. Therefore, the conditions applicable will be those in effect on the date of the order by the buyer.

2-Products

The products offered are those listed on berkey-france-millenium.fr by the company Premium Water Distribution SAS, within the limits of available stocks. Premium Water Distribution reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description including its main technical characteristics (capacity, use, composition...). The photographs are as accurate as possible but do not bind the Seller. The sale of products presented on berkey-france-millenium.fr is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

3-Prices

For countries in the Euro zone, the prices listed on the product sheets of the online catalog are in Euros (€) inclusive of all taxes (VAT included). For other countries, the mention of VAT does not include the applicable VAT in the delivery country. Therefore, all taxes due upon customs clearance are entirely the responsibility of the buyer. The buyer must be aware of the tax regulations in effect in the delivery country. Premium Water Distribution SAS is subject to the VAT regime, which means that VAT can be recovered by professional buyers. Any change in the VAT rate may be reflected in the price of the products. The company Premium Water Distribution SAS reserves the right to change its prices at any time, provided that the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated do not include possible additional delivery charges.

4-Order and payment methods

Before placing any order, the buyer must create an account on berkey-france-millenium.fr. The account creation section is accessible directly from the menu bar at the top of the pages. On each visit, the buyer, if he wishes to order or consult his account (order status, profile...), must identify himself using his information. The company Premium Water Distribution SAS offers the buyer to order and pay for his products in several stages, with 4 payment options to choose from:

- Payment by check: the buyer selects the products he wishes to order in the "cart", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. After validating the previous elements, the buyer chooses the payment method of his choice: "Payment by check" and accepts these general conditions of sale by checking the corresponding box, then invites him to pay for his order by clicking on the button "Pay my order". This last click forms the final conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of his order. In order to finalize his payment and trigger the processing of his order, the buyer must print this order form, accompanied by his check made out to "Premium Water Distribution SAS" at the address indicated upon order validation. No cash payment should be sent. Only checks issued by a French bank will be accepted. Upon receipt of the check, the order will be processed and the buyer will be informed by email. The company Premium Water Distribution SAS will ship the products no sooner than 2 working days after the check corresponding to the order has been cashed, subject to provisions.
For orders over 450 euros, payment by check will not be accepted and will be converted to bank transfer payment.

- Payment by bank transfer: the buyer selects the products he wishes to order in the "cart", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, any shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. After validating the previous elements, the buyer chooses the payment method of his choice: "Payment by transfer" and accepts these general conditions of sale by checking the corresponding box, then invites him to pay for his order by clicking on the button "Pay my order". This last click forms the final conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of his order. To finalize his payment and trigger the processing of his order, the buyer must contact his bank to make the transfer corresponding to the amount of his order to the bank account of Premium Water Distribution SAS, whose details are communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by email.
International transfers are not authorized. They generate fees that will be charged to the customer. Transfers must be made in SEPA format.

- Secure payment by credit card with E-Transactions from Crédit Agricole, our online payment partner: the buyer selects the products he wishes to order in the "cart", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, any shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. After validating the previous elements, the buyer chooses the payment method of his choice and accepts these general conditions of sale by checking the corresponding box, then invites him to pay for his order by clicking on the button "Pay my order". Finally, the buyer is redirected to the secure E-Transactions interface to securely enter his personal credit card details. The E-Transactions interface accepts credit cards, e-cards, Visa, Mastercard, and Paylib. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by credit card is irrevocable. In case of fraudulent use of the card, the buyer can request the cancellation of the payment by card, and the amounts paid will then be recredited or refunded. The cardholder's responsibility is not engaged if the contested payment has been proven to have been made fraudulently, remotely, without physical use of the card. To obtain reimbursement for the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must contest the debit in writing to his bank within 70 days of the transaction, or 120 days if the contract binding him to it provides for it. The amounts debited are reimbursed by the bank within a maximum period of one month after receipt of the written contestation made by the cardholder. No restitution fees can be charged to the cardholder.

- Secure payment by PAYPAL account: the buyer selects the products he wishes to order in the "cart", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. After validating the previous elements, the buyer chooses the payment method of his choice: "Payment with PAYPAL" and accepts these general conditions of sale by checking the corresponding box, then invites him to pay for his order by clicking on the button "Pay my order". Finally, the buyer is redirected to the secure PAYPAL interface to securely enter his PAYPAL account or personal credit card details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by PAYPAL account or credit card is irrevocable. In case of fraudulent use of the card, the buyer can request the cancellation of the payment by card, and the amounts paid will then be recredited or refunded. The cardholder's responsibility is not engaged if the contested payment has been proven to have been made fraudulently, remotely, without physical use of the card. - Secure payment by PAYPAL account in 4 installments: the rules for accepting payment in 4 installments are governed by Paypal and are not the responsibility of berkey-france-millenium.fr. The buyer must first choose the payment option by PAYPAL account, and it is in the Paypal interface that he will be offered the possibility of installment payment.

5-Retention of title

The company Premium Water Distribution SAS retains full and complete ownership of the products sold until full payment of the price, including principal, fees, and taxes.

6-Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of his order to exercise his right of withdrawal and return the product to the seller for exchange or refund. For more details on the return conditions, please consult our Return Policy.

7-Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Deliveries are made by UPS, UPS access point, Mondial Relay, La Poste, Chronopost, GLS, and DHL depending on the destination countries and the availability of the carrier in the buyer's delivery area. All delivery services allow the buyer to track his package using a tracking number. Packages are delivered against signature, except for tracked postal shipments. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated, and the buyer refunded. The company Berkey® France Millenium SAS may provide the buyer with the tracking number of his package by email. For pick-ups at relay points, if the buyer does not collect his purchase within the time indicated in the message received informing him of the availability of his package, the shipping and return costs of his order to the premises of Berkey® France Millenium SAS will be re-invoiced to him, as well as any new shipment. For home deliveries, in case of the buyer's absence, the carrier will either attempt a new delivery or drop the package at the nearest relay point in its network. It is the buyer's responsibility to check the tracking provided by the carrier to know the measures taken in his absence by the carrier.

PACKAGE DELIVERED TO ANOTHER RELAY POINT: it may happen that a relay point is changed during transit. The reasons for a relay point substitution are an internal decision of the carrier and cannot question the proper application of the delivery service. The customer is informed of the new relay point and/or may be asked to choose it via an instruction request received by email. The buyer is required to collect his package before the end of the storage period.

PACKAGE NOT COLLECTED IN TIME AT A RELAY POINT: In case of deposit at a relay point, the package will be held for 8 days. All efforts are made to allow the customer to track the transit and availability of his package. After this period, the return of an uncollected package to the warehouse will incur costs to the buyer.
The costs related to this non-collection will be applied in accordance with our return policy, under the Withdrawal paragraph.

RETURN PACKAGE HANDLED BY CHRONOPOST EUROPE: the shipping and return costs will remain the responsibility of the recipient and will be deducted from the refund.

The buyer must check the contents of each package upon arrival. In case of damage or missing items, it is essential to:
1 - Write SPECIFIC RESERVATIONS on the carrier's delivery document.
2 - CONFIRM THESE RESERVATIONS within 2 days to the carrier, by registered letter, justifying them (article 105 of the commercial code).
NO RECOURSE will be possible, even with Premium Water Distribution SAS once the merchandise has been accepted.
3 - The package should only be refused if its condition is completely degraded.

8-Warranty

All products supplied by Premium Water Distribution SAS benefit from the legal warranty of conformity provided by Article L. 217-4 and following of the Consumer Code and the warranty against hidden defects provided by Article 1641 and following of the Civil Code.
In case of non-compliance of a sold product, it can be returned to Premium Water Distribution SAS, which will take it back, exchange it or refund it.
The tanks of the filtration systems are guaranteed for 12 months.
Black Berkey® filters are covered by a proportional warranty for 2 years, calculated every 6 months, in full months from the date of delivery.
Seals and wing nuts are not covered by the warranty except for defects found during installation, and this for 6 months from the date of purchase.
The brushed appearance of the tanks cannot be considered a defect. Stainless steel tanks are produced using metallurgical processes, employing micro-sanding techniques. Brushed stainless steel tanks are not mirrors. The micro-sanding inside the tanks is more pronounced. The resulting micro-scratches cannot be considered defects.
PF-2 filter elements are guaranteed for 6 months. Sport Berkey® filters and the filtering bottle are guaranteed for 3 months. Other accessories are guaranteed for 6 months. The warranty period begins from the date of receipt of the product by the original buyer.
All claims, requests for exchanges, repairs, or refunds require the agreement of the Premium Water Distribution SAS after-sales service.
Premium Water Distribution SAS guarantees the products against material or manufacturing defects under normal use conditions.
Premium Water Distribution SAS cannot be held responsible for incidental or indirect damage caused to personal property, especially by a defective unit, improper use, misuse, accident, or negligence. It is the buyer's responsibility to prevent any misuse of the system and to replace parts when, due to natural wear and tear, they need to be replaced to benefit from the warranty service.
This warranty will not apply to units that have been used for unintended purposes, modified, or resulting in compromised performance. This warranty applies only to the original buyer and cannot be transferred.
To activate the warranty, the buyer must send an email request to mail Berkey France Millenium, indicating his order reference and date, name, first name, and the reason for his claim. Once the agreement is obtained, Premium Water Distribution will communicate the return procedures to the buyer and will send an email with a label to print for the package return. Product returns are free of charge during the entire warranty period.
The following actions automatically void the warranty coverage:
1. Allowing any Berkey® filter elements to freeze.
2. Using water from a dehumidifier with any Black Berkey® purification elements for daily use.
3. Breaking or damaging a Berkey® element due to a fall.
4. Causing system failure due to improper assembly or maintenance.
5. Forgetting to remove the Black Berkey® filters from the system before transporting or moving the system, causing the rods to break.
6. Conducting a red dye test with the Berkey PF-2™ fluoride and arsenic reduction filters connected. The Berkey® PF-2™ fluoride and arsenic reduction filters must be removed before performing a red dye test to remain in compliance with the six-month warranty on these filters.
7. Using water from a salt-based water softening system. This action risks clogging the Berkey® purification elements or causing stainless steel rust.
8. Not using Berkey® equipment according to the manufacturer's recommendations or instructions.

9-Liability

In the process of distance selling, Premium Water Distribution SAS is only bound by an obligation of means. Its responsibility cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other unintentional problems.

10-Intellectual property

All elements of the site berkey-france-millenium.fr are and remain the intellectual and exclusive property of Premium Water Distribution SAS. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site, whether in the form of a photo, logo, visual or text.

11-Personal data

Premium Water Distribution SAS is committed to preserving the confidentiality of the information provided by the buyer, which he may be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the internet user has the right to access, modify, and delete information concerning him. He may request this at any time by email to mail Berkey France Millenium. In addition, please consult our Privacy Policy.

12-Force majeure

The Parties will not be held responsible for the non-performance of their obligations in the event of the occurrence of a force majeure event, defined as any unforeseeable, irresistible event resulting from external circumstances to the Parties, making the performance of the Contract impossible.
In the event of the occurrence of a force majeure event, the Contract will be suspended until the disappearance, extinction, or cessation of the force majeure event. However, if it is impossible to resume the performance of the contract within thirty (30) days from the occurrence of the force majeure event, the Parties will meet to discuss a modification of the contract.
In case of failure of the discussion, the contract will be automatically terminated, without compensation from either party, by the most diligent party by registered letter with acknowledgment of receipt addressed to the other party.

13-Dispute resolution

These terms and conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be that of Auch.
